1. Acceptance of Terms

By accessing or using fishbro (the "Service"), including our website at fishbroai.com and our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and fishbro.

2. Description of Service

fishbro is a fishing companion application that provides the following features:

• Spot Discovery— Find and explore fishing spots near you with community-powered recommendations.
• AI Species Identification— Identify fish species using AI-powered image recognition.
• Catch Logging— Log your catches with photos, notes, and location data.
• Gear Tracking— Keep track of your tackle, rods, and gear inventory.
• Crews— Connect with fellow anglers, form crews, and share your fishing experiences.

3. User Accounts

To use certain features of the Service, you must create an account. You may register using an email address and password or by authenticating through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must provide accurate, current, and complete information during registration and keep your account information up to date. You may not create an account on behalf of another person or entity without their permission, and you may not use another person's account without authorization.

4. User Content

The Service allows you to submit, upload, and share content including catch photos, notes, location data, and other materials ("User Content"). You retain all ownership rights in your User Content.

By submitting User Content to the Service, you grant fishbro a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and otherwise make available your User Content solely for the purpose of operating, developing, and improving the Service. This license continues for as long as your User Content is stored on our platform and terminates when you delete your User Content or account, except where your content has been shared with other users who have not deleted it.

You represent and warrant that you own or have the necessary rights to your User Content and that your User Content does not infringe the rights of any third party.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Post or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorized access to the Service, other user accounts, or any associated systems or networks.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Scrape, crawl, or use automated means to access the Service without our prior written consent.
• Share fishing spot locations that are on private property without the owner's permission.
• Use the Service to promote illegal fishing activities or violate wildlife conservation regulations.

We reserve the right to investigate and take appropriate action against anyone who violates these provisions, including removing content and suspending or terminating accounts.

6. SMS Communications

By providing your phone number and requesting a verification code, you consent to receive SMS messages from fishbro for authentication purposes only. These messages contain one-time passcodes (OTP) used to verify your identity during sign-in or account actions.

• Message Frequency: One SMS message per authentication attempt.
• Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier and plan.
• Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message you receive from us.
• Help: For assistance, reply HELP to any SMS message or contact us at support@fishbro.com.

We do not use SMS for marketing or promotional purposes. SMS messages are sent exclusively for account verification via Twilio.

7. Intellectual Property

The fishbro name, logo, branding, and all content created by fishbro — including but not limited to text, graphics, images, software, and design — are the property of fishbro and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included content, nor may you reverse engineer or attempt to extract the source code of the software, unless applicable laws prohibit these restrictions or you have our written permission.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Species Identification: The AI-powered species identification feature is provided for informational and educational purposes only. Results may not always be accurate. You should not rely solely on AI identification to determine whether a species is safe to handle, consume, or release. Always exercise caution and consult local wildlife authorities or field guides when in doubt.

We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Fishing spot recommendations, weather data, and other information provided through the Service are for reference purposes and should not be relied upon as the sole basis for any decision.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FISHBRO AND ITS OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of, or inability to access or use, the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service, including AI-generated species identifications.
• Unauthorized access, use, or alteration of your transmissions or content.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason we deem appropriate.

You may delete your account at any time through the app settings. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy. Some information may be retained as required by law or for legitimate business purposes.

All provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of the United States.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Effective Date" at the top of this page and, where appropriate, providing additional notice through the Service or via email. Your continued use of the Service after any changes become effective constitutes your acceptance of the revised Terms.
